on #2. If I ever felt there was the possibility of discrimination, I would put other or decline to state. Also, I thought those were for government stats, not employers. I don't know where this person is applying for a job, but it can't be anywhere that I know of in the U.S.
And as far as #1 - I don't trust anything AOL says.
