Observer, I'm not so sure that "this sets a new precedent in books." Did you get a chance to read that editorial that I included in a post on April 07, 2006 at 13:00:38 with the title Re: Sorry, but it seems self-contradicting.
The writer makes a good argument that what Brown did is nothing new, but something practiced by even the greatest novel writers. I don't know exactly what issue or issues Brown won the case on, but that fact may have been part of it.
