To conclude: Instead of torture and setting up military commissions, it should have been the FBI doing the interrogations and prosecution done in federal courts. Those then found guilty would now be in Supermax prisons and there wouldn't be any need for an expensive Guantanamo Bay prison. The Bush administration caused the mess which is why the taxpayers have to keep paying for it.

The evidence obtained from tortue can't be used in any federal courts of law so the only judicial review that remains are the military commissions. As it stands even if it was taken to federal courts now, after all this time, prosecutors wouldn't be able to put enough evidence together to obtain guilty verdicts for many of those who deserve it. The military commissions' only recouse is to keep them in Guantanamo Bay.
