Thoughtful post, Miguel. Something I learned in my poly sci class was that the one branch of government that the founding fathers did not put a check and balance on was the judicial system. In his opinion, it was really the courts that rule the country because of their power and that nothing can be said once they rule and there is no other system to check for abuse of that power. That's why presidents and governers work hard at appointing as many judicial posts as they can, so they can reflect their parties stance through the courts and that's why it's always such a battle to get some supreme court judge affirmed.
