I am familiar with the education clauses under fair use. In fact, I mentioned it on this board yesterday I belive when I said that if NDN got in trouble over copyright I would probably point to our status as a legal ministry and claim that we were using the material to educate those we minister to. I'm not sure that this position is bullet proof for us, but it is the position I would take if I had to.

When I was performing in high school plays, even though it was a school, and we were not performing professionally for profit (and it was for a class project for which we received grades), we still had to pay a royalty for each performance to avoid copyright infringement. The school was also required to furnish each student with an original copy of the play, not a photocopy. This was also standard practice in the amature "Little Theatre" groups I performed with.

I don't read what you just posted as saying:

"in cases of public interest, the reproduction of copyright material is allowed even under protest of copyright holders"

But, that's why they have courts. One side is always reading the same law in a way that they feel illustrates their own point.

I guess all I can say is, good luck. I hope you win.
